These Terms & Conditions (“Terms”) govern your use of the HAVN platform available at havnestate.com. By accessing or using HAVN, you agree to be bound by these Terms. If you do not agree, you must not use the platform. HAVN operates as an online marketplace connecting homeowners with real estate agents and is not a real estate agency, broker, or licensed intermediary. HAVN does not provide real estate advice, does not represent buyers or sellers, and is not a party to any transaction between users.
HAVN provides a platform where homeowners can list properties and agents can browse and engage with those listings. All property transactions, agreements, negotiations, and commissions occur directly between homeowners and agents outside of HAVN. HAVN does not verify the accuracy of listings or guarantee outcomes, and users rely on the platform at their own risk.
Homeowners agree that all information provided, including property details, images, and descriptions, must be accurate, lawful, and not misleading. Homeowners are responsible for ensuring they have the legal right to list the property and engage with agents. Listing a property on HAVN does not create any exclusive relationship with HAVN, and homeowners may engage with other platforms or agents independently.
Agents must hold a valid real estate licence and comply with all applicable laws and regulations in their jurisdiction, including requirements under New Zealand law. Agents are solely responsible for entering into legally binding agency agreements directly with homeowners before undertaking any sales activity. HAVN does not verify licensing, qualifications, or conduct and accepts no responsibility for agent actions, performance, or compliance.
Agents may access certain features of HAVN through a paid subscription. By subscribing, agents agree to pay all applicable fees for their selected plan. Payments are processed securely through Stripe, and by using HAVN, you also agree to Stripe’s terms. Subscription fees are billed in advance regularly. You may cancel your subscription at any time, and cancellation will take effect at the end of the current billing cycle. Except where required by law, all fees are non-refundable. HAVN reserves the right to change pricing, features, or subscription terms with reasonable notice.
HAVN may suspend or terminate your access to the platform at any time if you breach these Terms, engage in fraudulent or unlawful behaviour, misuse the platform, or fail to meet legal obligations. You agree not to use HAVN for any unlawful purpose, to submit false or misleading information, or to interfere with the operation or security of the platform.
To the maximum extent permitted by law, HAVN excludes all warranties, express or implied, including any warranties of fitness for purpose, reliability, availability, or accuracy. HAVN provides the platform on an “as is” and “as available” basis. HAVN will not be liable for any direct, indirect, incidental, special, or consequential loss, including loss of income, loss of opportunity, failed transactions, disputes between users, or reliance on platform information.
